What is Social Security Disability?
Social Security Disability is a federally mandated insurance program. Most workers and employers in the United States pay FICA taxes, which fund disability, retirement, and Medicare benefits.
What are the requirements to qualify for SSDI?
You must be below full retirement age, have paid into the FICA program, and be unable to sustain substantial gainful activity (SGA) for a period of at least 12-months due to a severe health condition.
How much does Social Security Disability pay?
Monetary benefits are determined based on your payments into FICA. The easiest way to confirm your eligibility and benefits is to set up an account on ssa.gov
Is Medicare included with Social Security Disability?
Social Security Disability beneficiaries are entitled to Medicare after receiving SSDI payments for a period of at least 24-months. Non-disability Medicare entitlement begins at age 65.
How are lawyers paid?
SSDI attorneys work under a fee structure established by the Social Security Administration. Attorneys may only collect fees for claims that are ultimately approved. Fees are currently limited to 25% of any backpay recovered for the claimant, with a cap that is adjusted periodically (currently $7,200. Attorneys may also seek reimbursement for out-of-pocket costs associated with the representation.
What if my case goes to the Appeals Council or Federal Court?
For successful claims that go through the Appeals Council and/or Federal Court review process, Attorneys may generally charge 25% of the backpay recovered, but the cap set by SSA does not apply. Attorneys may also seek payment of fees directly from the government under the Equal Access to Justice Act.
